Villy Lopman and Karmen Kaplinski, in cooperation with the Ministry of Finance, conducted training on the subject of comprehensive plans and property restrictions
On December 11, RASK attorneys, in cooperation with the Ministry of Finance, trained planning specialists and local government officials. The topic was various ownership restrictions set by the local government during the planning procedure. The training provided an overview of the positions and interpretations that have emerged in the practice of the Supreme Court and lower courts in connection with the right of local governments to set restrictions on felling in the comprehensive plan.
The rights of local governments in relation to restricting felling have long been the subject of discussion. The subject is especially topical also due to the fact that currently local governments are preparing new comprehensive plans and the so-called forest debate has reached almost every local government. For this reason, it is sensible to review whether and how many conflict issues have in fact already been answered in case law and where the bottlenecks of the restrictions are located.
