RASK represents Padise rural municipality in an extraction permit dispute.

Case

RASK successfully represented Padise rural municipality in a dispute arising from the procedure involved in issuing an extraction permit. RASK’s advice led to Tallinn Administrative Court and Tallinn Circuit Court refusing to open proceedings on the action and the Supreme Court refusing leave to appeal.

On 18 December 2013, the council of Padise rural municipality approved a draft extraction permit for building a new gravel quarry in Audevälja village, which was pending with the Environmental Board. The approval of the council of Padise rural municipality as an administrative measure was challenged in the administrative court by the Audevälja village community.

Thanks to RASK’s advice, both Tallinn Administrative Court and Tallinn Circuit Court refused to open proceedings on the action. The applicants submitted an appeal to the Supreme Court but, on 17 June 2014, the Supreme Court refused leave to appeal.

All court instances agreed with the case argued by RASK that the approval of the extraction permit by the council of the rural municipality as an administrative measure is not individually contestable in this case.
