RASK represents Päraküla Selts in dispute over deforestation in green infrastructure core area.

Case

RASK represents the Päraküla Selts in several court disputes with the Environmental Board concerning more than 10 forest notifications. The disputed forest notifications issued by the Environmental Board mostly allow for clear-cutting on properties located in core areas of the local green infrastructure.

The dispute has broader significance for two reasons. First, it concerns a fundamental question about the substantive meaning and objectives of green infrastructure core areas. In other words, the dispute is about whether allowing intensive logging in these core areas – that is, areas with the highest level of biodiversity – is in line with the concept and objectives of the green network.

The second key issue is whether forest notifications registered as “decisions made by an automated system” can be regarded as legitimate use of discretion.
