RASK represents city of Põltsamaa in complicated ownership dispute.

Case

RASK successfully represented Põltsamaa City Government in a complicated ownership dispute with a local driving school – non-profit association “Autom” Põltsamaa Liiklusklubi. All court instances involved found in favour of Põltsamaa City Government.

Since 1980, Autom had been using the classrooms of the local school (2 Lille Street) without charge. In December 2010, Põltsamaa City Government requested that Autom vacate the premises so that the City Government could use them, but Atom refused. So began a complicated ownership dispute with facts relating to events and documents dating back to 1976.

Both Tartu County Court and Tartu Circuit Court ruled that Autom has no right to the Põltsamaa Ühisgümnaasium classrooms and Autom has to vacate them.
