Successful Defense of Powergen OÜ in Backup Power Procurement Dispute

RASK’s attorney-at-law Keidi Kõiv successfully represented Powergen OÜ in a procurement procedure organized by State Real Estate Ltd (Riigi Kinnisvara Aktsiaselts), aimed at selecting a contractor for the construction of backup power systems at the Estonian Academy of Security Sciences, located at Kase 61, Tallinn.
RASK represented the client in a dispute initiated by a competing bidder, who claimed that the generator proposed in Powergen OÜ’s tender did not meet the procurement requirements. Attorney-at-law Keidi Kõiv demonstrated during the proceedings that the generator offered by the client was a custom-designed solution and fully met all the technical specifications outlined in the procurement documents. Since the tender conditions did not require the submission of a product description but rather confirmation of compliance, Powergen OÜ had submitted its tender in accordance with the applicable rules.
The Public Procurement Review Committee agreed with RASK’s position and concluded that the generator proposed by Powergen OÜ complied with the contracting authority’s requirements.
