RASK advised Hepta Group Airborne on UAV IP matters

Case

RASK’s attorney-at-law Andrei Svištš advised and represented Hepta Group Airborne in connection with intellectual property matters concerning the Community design of a UAV platform developed by the client.


Hepta Group Airborne had filed a civil claim to obtain the rights to the Community design of a helicopter-drone platform, which they had been continuously developing. The design was initially created by Hepta Group Airborne shareholders (Siim Maripuu and Siim Heering). However, the defendant, Instigo Eesti, had registered ownership of the Community design and claimed that it had obtained the rights through an EU-funded project executed by the Estonian Aviation Academy, in which Hepta Group Airborne’s shareholders had participated. The dispute arose at the conclusion of the project, when the shareholders chose to discontinue cooperation with Instigo Eesti and instead partnered with Hepta Group Airborne.


The court of first instance ruled in favour of Hepta Group Airborne, and the parties subsequently concluded a friendly settlement in the second instance.
