RASK consults client in court dispute with ARIB over project grants.

Case

RASK consulted a client in an administrative dispute with the ARIB over the purposeful use and preservation of a building acquired with investment support. The ARIB found in their preliminary assessment that our client had violated the requirements for the purposeful use and preservation of the object of the investment, and therefore all the support payments should be recovered.

The dispute focused on the volume of the work to be performed according to the applications, the degree of completion of the building and, consequently, the functions of the building. After our client's position was explained in a hearing, the ARIB decided that the recovery claim was unwarranted and the building was being used according to the objectives of the investment support.
