Tallinn Circuit Court confirms RASK’s case in criminal proceedings over Pere AS insolvency
On
3 September 2020, the Criminal Chamber of the Tallinn Circuit Court
acquitted Rein Kilk and Kaie Kilk, former members of the supervisory board of
Pere AS, Neeme Raig, former member of the management board of Pere AS,
and Kristjan Oolo, former member of the management board of Pere Pagar OÜ, for
the third time on charges brought against them in the criminal case relating to
the insolvency of Pere AS. The members of the management bodies of Pere AS and
the member of the management board of Pere Pagar OÜ are represented in the
court dispute by RASK attorneys Ramon Rask, Tarmo Peterson and Andrei Svištš.
“I am pleased that the Tallinn Circuit Court made a very substantial decision,” said RASK partner Ramon Rask. “In today’s judgment, the court has relied on a thorough analysis, and based on this substantive analysis, concluded that none of the alleged acts harming the company were committed.” More specifically, Tallinn Circuit Court found in its judgment that the transactions for which the members of the management bodies of Pere AS have been accused did not cause the loss of value of the assets of Pere AS.
The pre-trial procedures included the Pere AS insolvency case that has been pending since 2012. During this time, the case has been heard by the Tallinn Circuit Court on three separate occasions. The court acquitted RASK’s clients first on 7 November 2018, then on 27 November 2019 and for the third time on 3 September 2020.
The prosecutor’s office may file a cassation appeal against the Tallinn Circuit Court judgment with the Supreme Court within 30 days.
